On 5/04/22 at 9:00 AM Licensing Program Analyst (LPA) Lorraine Dacanay Breaux and Elimika Woods conducted a Complaint Investigation at Adventures in Learning and met with Director Ana Fernandez. Present for today's inspection was 59 children and 7 staff.

During the course of the investigation, the Department inspected the facility, reviewed videos/records, and conducted interviews. It was confirmed that a child was hit by a teacher while in care. Based on the observations, records and interviews which were obtained throughout the investigation, the preponderance of evidence standard has been met, Therefore, the allegation is SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on 9099-D page.

Due to the issuance of a Type A Citation during today's inspection, a copy of this Licensing Report must be POSTED in the facility and PROVIDED to each existing parent by the end of today or next day child is in care. Report also has to be PROVIDED to the parent of children who are enrolled over the next 12 months. In addition, a copy of the LIC 9224 Acknowledgement of Receipt of Licensing Reports must be signed by each parent and kept in each child's file for three years.

LPAs discussed with director the seriousness of the substantiated finding for this complaint. Exit interview was conducted, where this report, the deficiency, plan of correction, and appeal rights were discussed with Director, Ana Ferandez.

During the course of the investigation, the Department inspected the facility, reviewed records, and conducted interviews. Based on the observations, records and interviews which were obtained throughout the investigation, the preponderance of evidence standard has been met, therefore, the allegation is UNSUBSTANTIATED.

“Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.”

Exit interview was conducted, notice of site visit provided and appeal rights were discussed with Director, Ana Fernandez.

By June 1, 2022, Director and staff will watch the Personal Rights Video on CCLD website and formulate a plan on how to ensure safety of children. Director proof of staff meeting with discussed agenda points and staff attendance.

Per LPA’s investigation, it was determined that teacher hit the child in care. Video was reviewed with director and staff. This is a violation of Personal Rights and an immediate risk to the health and safety of children in care.
