LPA Dyer met with Director Betty McGhee for an unannounced Required - 1 Year Inspection. Present with the director is 1 fingerprint-cleared additional staff member and 12 school-age children. There is 1 large classroom. Sign-in/sign-out sheets list the time and parents' full signature. There is a working phone. The last fire/emergency drill was 4/11/22. Director and Designation of Facility Responsibility is current. Proper posting requirements were met. There is a carbon monoxide detector and a fire extinguisher.
Classroom furniture is in good condition. There are toys, books, crafts and educational supplies available. Floors were clean and safe. There is adequate heating, ventilation, and lighting. LPA did not observe any child left without visual supervision or unattended during the inspection. Bathroom toilets and sinks are working properly. Children are able to reach the sinks. There were adequate bathroom supplies. Kitchen area (including storage areas for food) was clean. No insects or pests were seen. There were storage containers with lids for solid waste. A sample of food product was examined for freshness and expiration dates; there was adequate food for children who did not bring their own and for emergencies. Food is prepared inside the facility. The center supplies snack. Menus were posted. Inside, there is proper storage areas for each child with hooks for personal supplies. cubbies. Children do not nap at the facility. There is drinking water available at all times inside and outside the center through dispensers and paper cups. Director stated that there were no bodies of water or firearms on the premises. First aid kit is located in the kitchen. Director has emergency earthquake supplies. Cleaning supplies are inaccessible to children, placed in the kitchen.
Outside play area (securely fenced) is safe and free of hazards. There were a variety of toys and play materials such as balls, arts/craft supplies, bouncy balls, puzzles, basketball hoop, etc. There is an outside shaded area.
New Regulations: Required Lead Testing for Drinking Water - A licensed child day care center, as defined in Section 1596.76, that is located in a building that was constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. Licensee had water tested this month. (continued)

(2) (A) A licensed child day care center subject to paragraph (1) shall collect and submit drinking water samples to a laboratory accredited pursuant to Article 3 (commencing with Section 100825) of Chapter 4 of Part 1 of Division 101. A laboratory receiving a drinking water sample pursuant to this paragraph shall, in a timely manner, electronically submit its test results to the State Water Resources Control Board using lead data submission methods that are acceptable to the State Water Resources Control Board. If the test results show elevated lead levels, the State Water Resources Control Board shall, in a timely manner, report the results for the affected licensed child day care center to the department.
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm. Children's files (sample) were examined. They list emergency information, a medical assessment, and an Admission Agreement. Employee records were examined and discussed. All individuals subject to a criminal record review have obtained clearance or a criminal record exemption.

The director was reminded of the Department's Inspection authority, and the need to comply when notified that termination of an employee is necessary. Discussed with the director: adult immunizations, substitutes; signage; smoking; mandated reporter training; and pest management.
