On 06/26/2024 at 2:15pm, Licensing Program Analysts (LPAs) Jialing Zhu and Lorraine Dacanay-Breaux arrived at the facility for an unannounced annual inspection. LPAs met with director Yakkeling Esquivel. There were nine (9) infants and four (4) fingerprint-cleared staff members present during the inspection. This program is part of a combination center which also includes a preschool component. The facility was toured for a health and safety inspection. The hours of operation are Monday through Friday, 6:30am to 6:00pm.

Furniture and napping equipment observed during inspection were age appropriate and in good condition. The indoor and outdoor activity space for the infant program is physically separated from the preschool component. Each crib is occupied by only one infant at a time, and is free from all loose objects, including blankets and pillows. Disinfectants, cleaning solutions, poisons and other items that are dangerous to children were inaccessible during the inspection. The toilets and sinks were clean and in operable condition. The floors were free of tripping hazards. Kitchen/food preparation and storage areas were observed to be clean, and free of evidence of rodents, and food is protected against contamination. All storage containers for solid waste have tight-fitting covers that are in good repair. Drinking water is available both indoors and outdoors. Menus were posted and visible for parents to view. There are no pools or similar bodies of water at this facility. Outdoor activity space and playground equipment were observed to be safe, free of hazards and had appropriate cushioning material to absorb falls. There is a shaded area provided for the children. Required licensing documents were posted. Fire extinguishers, carbon monoxide and smoke detectors meet State Fire Marshall standards.

The facility is operating within its licensed capacity. However, one out of the two classrooms did not have a fully-qualified infant teacher. LPA did not observe any child left without visual supervision during the inspection. LPAs verified both opening and closing staff have current CPR/First aid training. The center is in compliance with the sign in and out procedure using an electronic app. Three (3) children and three (3) staff files were reviewed.

The following deficiencies were cited during today’s inspection:


· Infant Room did not have a fully qualified teacher.
· Infant Sleep Plans (LIC 9227) are not completed. (LPA provided form to Director.)
· Infant Needs and Services Plans are not updated quarterly.

See LIC809D for deficiencies cited during today's inspection. Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP).

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP

LPA referred facility representative to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at
https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with facility representative Yakkeling Esquivel. Appeal Rights were also provided.
