25 | On 11/15/23 at 11:12am, Licensing Program Analyst (LPA) Catherine Fernandes arrived unannounced on case management inspection regarding a self reported incident that was provided to the Oakland Community Care Licensing office. LPA Fernandes met with owner Cindy Acker and explained the purpose of the visit. Present during the visit was 20 preschoolers and four additional staff members.
There was an incident that occurred on 11/13/23 involving a preschool teacher grabbing a child to stop the child for running in the classroom. The day of the incident the teacher was immediately sent home and has not returned to the center since the incident. LPA Fernandes conducted interviews, collected documents pertaining to the incident and based on the information obtained a child's personal rights were violated resulting in a Type A citation. The citation was cleared during the visit, LPA Fernandes was given dates by Cindy Acker for the scheduled training that was planned prior to the citation.
LPA Fernandes informed owner Cindy Acker that this report dated 11/29/23 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the personal rights of children in care. Also, LPA Fernandes informed the Acker to provide a copy of this licensing report dated 11/29/23 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
