On 7/20/2023 at 2:20pm, Licensing Program Analyst (LPA) Laura Chavez conducted an unannounced follow-up complaint inspection to the facility and met with Elizabeth Givens, Director. It has been alleged that daycare children are not treated fairly by staff, specifically, that a child in care is sent home continuously for behavioral issues while other children with similar behavioral issues and or concerns are allowed to remain at the facility. It was also alleged that staff are forcing daycare children to nap.

On 3/27/2023 Director Elizabeth Givens denied the allegations and stated that all children are treated fairly and equally. Director Givens denied that any child in care is being singled out and sent home for behavioral concerns. Director Givens denied children are forced to nap. Director said children who do not want to nap are given the opportunity to look at a book quietly while remaining on their nap mat or go to one of the tables and work on a quiet activity.

Interviews conducted on 3/27/2023, with Staff 1, Staff 2, and Staff 3 between 9:19am – 10:33am stated all children in care are treated fairly and denied that any one child is singled out and sent home for behavioral issues. Parent 1, Parent 2, Parent 3, and Parent 4 denied having knowledge of any child being forced to nap. Staff 1, Staff 2, and Staff 3 denied any child in care being forced to nap. Staff 1 – Staff 3 stated children who remain awake during nap time are given the opportunity to read a book while on their mat or work on a quiet activity while sitting at a table.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted, appeal rights were provided, and a Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
