25 | A Case Management visit was conducted on 12/2/21, by Licensing Program Analyst Wisehart who met with the director, Danae Luper.
The visit was to review an incident where staff (S2) restrained a child for 4 minutes due to a behavior. The child was witnessed too be held in a restraining hug on several occasions because staff did not know how to deal with the child’s behaviors and to protect other children in care. The director stated that S2 might have held him because the child was throwing things and hurting other kid’s, so the staff had to control C1’s body. Interviews with 5 out of 16 witnesses acknowledged that they either observed S2 restrain child C1, up to once a week, or that they were called and notified that this incident had happened. S2 acknowledged that C1 has been restrained on 3-4 occasions, for 2-3 minutes when the child was throwing chairs to protect other children.
The visit was also to discuss the facility practice of asking school aged children to rub the backs of preschool children at nap time. The director stated that the kindergartners are asked if they want to help pat backs at nap time. Interviews with 2 out of 3 children (C2-C4), indicated they are being asked to volunteer to rub backs of preschoolers during nap times, though neither are of kindergarten age. Interviews indicated that 4 out of 16 (W1-W16) witnesses expressed that at least daily, one school ager was sent to the nap room along with staff to help rub children’s backs. It was acknowledged that a parent once asked why her son was touching other children on the back and rubbing them and another witness expressed that their school aged child had mentioned rubbing preschoolers backs at nap time.
The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided. Reports citing Type A violations are to be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file.
