13 | On 12/20/21, at 10:05 am, Licensing Program Analysts (LPA) Chavez and Wisehart conducted an unannounced complaint inspection, and met with licensee/director Ronda Gambone and Kylie Miller. It was alleged that the facility is not following COVID-19 facial covering guidance, specifically that children in care are not wearing facial coverings.
The licensee/director was interviewed on 12/20/21, at 10:05 am and stated that the facility’s policy regarding facial coverings for children is to encourage them but not force them. The licensee/director has provided a policy given to parents about mask requirements. The licensee stated that facility staff attempt to keep children wearing their facial coverings by modeling and positive reinforcement but they do not force children to wear masks and they don't keep extra masks on site, the children only have what the parents provide.
The LPAs toured the facility at 10:10 am. The LPAs observed mask signage posted on the front door and all staff wearing masks. There were a total of 28 children observed inside and they were starting to transition to outside play and non were wearing masks and no masks were available inside for them to wear when they returned inside.
Six staff were observed to be in compliance with the mask requirements. No medical exceptions were noted on file for children's regarding mask wearing.
Provider Information Notice (Pin) 21-29-CCP FACE COVERING REQUIREMENTS AND GUIDANCE FOR CHILD CARE PROVIDERS REGARDING CORONA VIRUS DISEASE 2019 (COVID-19) was discussed and a copy was provided during the inspection.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted. The Notice of Site Visit must be posted for 30 days.
