32 | Interviews with staff (S1-S6) on 8/5/21 indicated that in general ratio’s are being met, including during nap times. Staff indicated they can call for back up help when needed. Staff indicated they try to redirect awake children to quiet activities. S2 acknowledged that on 8/4 they had 4-5 active kids who eventually went to sleep, though one child was sent home, and another was sent to another classroom. S2 also acknowledged being the sole staff in the room for about 10 minutes. Interviews with witnesses (W1-W4) on 8/4/21 & 8/19/21, indicated that 3 out of 4 witnesses felt the staffing was fine and no concerns were noted. W1 indicated recent concerns with staff turnover and felt there was less staffing in the afternoon hours. W1 also indicated witnessing on 8/4 around nap time; one staff with 12-15 children who appeared frustrated and observed 3 awake children.
The LPA reviewed records to include staff schedules/timecards; attendance worksheets and a room video for the Bears classroom for 8/4/21 between 12-12:30 pm. The LPA counted 14 children per the video angle, though the class roster shows 15 children would have been in care during this period, with one staff for a period of about 10-12 minutes. The LPA observed that 6-7 children appeared to be actively awake, several were transported by staff or were walking around the room.
The LPA has determined that a second staff should have been present during nap time due to awake children, resulting in the facility being outside of napping ratio’s on 8/4/21.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated.
The following violation(s) of the California Code of Regulations, Title 22; Division 12, were observed: see LIC 809D. Appeal Rights were provided. Reports citing Type A violations are to be provided to parents/guardians of children currently in enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC9224 to be kept in each child's file.
