LPA Mendez interviewed seven parents of children in care on 11/4/21, 11/15/21, 12/10/21 and 1/19/22. LPA Mendez asked parents (P1-P7) if they witnessed their child or any child in care being spanked by an adult in the home. P1 stated that a child, C1 had witnessed an adult spank a child (C2) because C2 refused to take a nap. P2-P6 stated they never witnessed an adult spank a daycare child.

LPA Mendez interviewed seven parents whose children are in care, they were interviewed on 11/4/21, 11/15/21, 12/10/21. LPA Mendez asked parents if their children are forced to take long naps while in care. Two out of the seven parent interviews confirmed the licensee forces their children two nap. Five of seven parents interviewed denied the allegation.

LPA Mendez interviewed eight children on 11/4/21 and 11/5/21 two of the eight children were qualified by LPA Mendez to be interviewed. LPA Mendez asked C1 who hit C2, C1 stated another child had hit C2. LPA Mendez asked if an adult spanked C2, C1 then stated that A1 hit C2 on the butt and hurt C2 that C2 was crying. LPA Mendez asked C2 who hit them and C2 was unable to pronounce a name. LPA Mendez asked C2 where were they hit, C2 stated they were hit on their tail in reference to their butt. Of the two children that could be interviewed, C1 stated they liked to take naps at the daycare. C2 did not comment.

LPA Mendez interviewed Staff (S1) on 11/5/21 and addressed the allegation of children being forced to nap, S1 stated that children are not forced to nap. S1 stated the children do get tired after lunch. They will close the blinds, put music on and read them books and sing songs until they fall asleep on their own. LPA Mendez asked S1 if they had witnessed S2 spank a child and S1 stated no.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
