On 3/4/21 at 10:00 AM, Licensing Program Analyst (LPA) Sandy Husband conducted an announced complaint inspection, and met with Director Kelli Koller to deliver findings. It was alleged that a lack of supervision resulted in children hurting each other when C1 hit C2 on 9 separate occasions in the face with a rubber ball, also grabbed the child's wrist and called C2 names throughout the day on 5/11/20. It was further alleged that a lack of supervision resulted in an inappropriate interaction between two children when C1 threw a ball at C2's head and then licked C2's pants and underwear on the butt area of the pants. The licensee was interviewed on 5/22/20 at 1:30 PM and denied the allegations explaining there was supervision who witnessed these incidents. The Licensee stated there was an incident between the two children when they were playing and began to hit each other, but it was immediately broken up by staff (S1) on 5/11/20. Licensee also stated that staff witnessed on 5/12/20, C1 throw a ball and hit C2 in the face and the ball caught him off guard. Licensee denied the allegation regarding an incident where a child

licked another child's pants and stated "it absolutely was not happening" and had never witnessed anything like that before at this facility. In further interviews in was determined that school age children are not allowed to use the restrooms together and must use them alone for privacy with a teacher standing outside the door. Five staff, 1 child and 3 parents were interviewed on 5/22/20, 2/25/21, 3/2/21, 3/3/21 and 3/4/21 corroborating that both incidents were witnessed by staff and when C2 was hit in the face with the soft, rubber ball, the two children were playing catch and it was unintentional. During the investigation, it was corroborated that when the two boys were having an argument over a toy, it quickly escalated into a tug-o-war that was immediately broken up by S1 in which C1 then let go of the toy at the request of S1, and the toy hit C2 unintentionally in the chest. It was further confirmed that children are not allowed to use the restrooms together and there has never been an incident witnessed where a child licked another child's pants because they were under constant supervision and a staff person is always placed by the restroom door when in use. Low census was corroborated during the investigation with 13 children and three (S1-S3) staff present on 5/11/20 with 10 children and 2 supervising staff (S1-S2) present on 5/12/20. During today’s visit the facility was toured and LPA observed 6 staff positioned in a manner to where all 22 children were visually supervised during outdoor play. LPA Husband also observed the restroom and the Director verified that school age children do not use this restroom anymore, but on 5/11/20 and 5/12/20, the school age children always used the bathroom separately with privacy provided. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, and the findings are unsubstantiated. An exit interview was conducted.
