32 | LPA’s Husband and Wisehart, interviewed 5 out of 5 staff (S1-S5) on 6/18/21; 6/21/21; 6/23/21; 6/24/21; 6/25/21; 6/30/21; 7/1/21. S2 denied putting a foot on a child’s neck to get C4 off from the staff. Other staff expressed never witnessing inappropriate interactions involving S2 with the children. Staff consistently stated they do not inappropriately discipline a child and that when a child is having behaviors they will talk with the child, get down on the child’s level and encourage use of verbal instead of physical expressions.
The LPA interviewed 4 out of 4 children (C1-C4) on 6/30/21 and on 7/2/21. 3 out of 3 children denied having ever witnessed a staff step on a child and overall expressed the staff were nice. Interviews indicated that staff discipline children by putting them on time outs during behaviors. C4 maintained that S2 stepped on the child’s neck, while the child was pulling the staff’s arm in attempt to get the child off from the staff while in the bathroom. C4 indicated no other witnesses were present. C4 could not articulate the time frame when the incident happened.
The LPA has determined, that though C4 has consistently stated that staff S2 stepped on the child’s neck, S2 was the only other person present and has denied the incident. The LPA reviewed internal incidents for C4 documented from 3/4/21 – 6/17/21; none noted arm pulling or noted bruises. Though W2 saw a bruise around C4’s neck/collar bone in the Spring of 2021, W2 expressed being unsuccessful when trying to interview the child and therefore, could not determine if the bruise happened at the day program or at the child’s school program. Therefore, the LPA concludes this allegation to be unsubstantiated.
Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation violation occurred, and the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
