On 6/12/24 @ 8:35am, Licensing Program Analysts (LPA's) Erica Laird and Kayla Danielson conducted an unannounced complaint inspection, and met with facility owner/director Heather Lingemann. It was alleged staff did not follow child's feeding plan; specifically, staff gave child (C1) food which contained ingredients causing an allergic reaction, and staff did not report incidents to appropriate parties; specifically, staff did not report the allergic reaction to licensing.

On 4/16/24 @ 1:16pm LPAs Erica Laird and Syndey Sims interviewed facility director/owner Heather Lingemann. Heather stated there was an incident involving a child (C1) who had an allergic reaction to a food that was brought into the facility. Heather stated allergies were discussed prior to bringing in the food, but one ingredient was overlooked. Heather stated allergies are posted in the Brightwheel app. and posted on the refrigerator in the kitchen. Heather stated she did not report the incident to licensing because the child did not require medical attention.

On 6/10/24 and 6/12/14 Licensing Program Analyst (LPA) Erica Laird conducted four staff interviews (S1, S2, S3, S4). S1,S3, and S4 stated they recall an incident when a child had an allergic reaction to an ingredient in food which was brought to school for a special occasion. S1, S2, and S4 stated staff were unaware there was an ingredient in the food which would cause the allergic reaction. S1, S2, and S4 stated allergies had been discussed prior to the occasion to ensure nothing was served which would cause an allergic reaction. All staff interviewed stated allergies are posted in the Brightwheel app and in the kitchen. All staff interviewed stated they inform the director when there is an incident which requires reporting to licensing.

On 5/20/24 Licensing Program Analyst (LPA) Erica Laird conducted an interview with a parent (P2). P2 stated they had discussed class allergies with the director prior to bringing food for the class. P2 stated they didn't realize the food contained an ingredient which would cause an allergic reaction. P2 stated the director had called for a list of the ingredients and that is when they discovered the ingredient which had caused the allergic reaction. P2 stated the facility discussed allergies at the time of enrollment and posted allergies in the kitchen.

On 4/16/24 LPA's Erica Laird and Sydney Sims obtained messages from the Brightwheel app, the parent handbook, and the facility roster. Messages in the Brightwheel app corroborate communication regarding C1 having ingested food which caused an allergic reaction.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.

LPA's Erica Laird and Kayla Danielson informed facility owner/director Heather Lingemann that this report dated 6/12/24 documents 1 Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.


Also, LPA's Erica Laird and Kayla Danielson informed owner/director Heather Lingemann to provide a copy of this licensing report dated 6/12/24 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the facility owner/director, Heather Lingemann.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
