32 | It was also alleged the facility staff are retaliating against the parent P2 for filling a complaint, specifically not answering calls. Based on interviews with the director on 8/18/21, the director stated that the staff do not carry the facility phone with them at all times, and P2 feels they are screening the calls. In an interview with P2 on 9/14/21 it was stated that staff have been answering all questions via the portal app and calls over the last month. Interviews with 5 staff on 9/16/21 and 9/17/21 stated that they have updated the portal per usual and are not aware if calls are screened or left unanswered. Interviews with 6 witnesses stated that staff were made aware of any custodial requirements for pick up of C1 and nothing more. Interviews with 6 staff all corroborated that C1’s injury was not updated in the portal due to human error and it was not in retaliation. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. |
