Licensing Program Analyst (LPA) N. Cunningham conducted a subsequent inspection to deliver the finding regarding the allegations mentioned above and met with Licensee Brown. LPA Cunningham previously met with Licensee Brown on 01/26/22 and 03/09/22 to discuss the allegations. It was alleged that children are forced to lay down at naptime, there is an aggressive dog around the children, there are dog feces in the outdoor play area, and facility is operating out of ratio. The licensee admittedly denied all of the allegations.

Through the course of the investigation, starting from 01/26/2022 through 03/24/2022, LPA interviewed the licensee and four adults.

Regarding children are forced to lay down at naptime, two adults reported that their child is allowed to rest or do a quiet activity while the other children nap, one adult reported that they are not aware of the licensee requiring their child to nap, and one parent reported that their child naps at the facility.

Regarding there is an aggressive dog around the children, two adults reported that they have observed the licensee’s dog, Chase, jump on an adult in an aggressive manner and two adults reported that they have always observed Chase to be friendly and nonaggressive. On 01/26/22, LPA observed Chase act friendly. On 03/09/22, LPA observed Chase move quickly towards her and attempt to put his paws on her. During LPAs inspections, LPA did not observe Chase act aggressively towards children in care.

Regarding there are dog feces in the outdoor play area, LPA observed dog feces in the backyard in areas used for childcare while children were playing inside. The licensee stated she inspects the yard and picks up all droppings before children go outside. LPA observed a covered garbage can with dog feces in it. Four adults reported that they have not observed dog feces in the backyard while children were playing outside.

Regarding facility is operating out of ratio, LPA observed the licensee operating within ratio on two occasions and closed on one occasion. On 01/26/22, LPA observed and photographed a white board which the licensee stated list children in care per day. The licensee stated that she never operates at maximum capacity. There was no evidence to confirm that the facility is operating out of ratio.

Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, and the findings are unsubstantiated. Appeal rights were provided, and an exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
