On 11/19/2021 at 10:40am, Licensing Program Analyst (LPA) Laura Chavez conducted an unannounced complaint inspection to the facility and met with Lead Teacher (LT) Wanda Stephens. It was alleged that a day-care child was left in a soiled diaper for an extended period of time. Specifically, that on 11/3/2021, C1 was left in the same diaper the child arrived in at 7:30am until the child was picked up at 1:30pm.

LT stated that on 11/3/2021 C1's parent arrived at approximately 1:30pm and found C1 in a wet and soiled diaper. LT said after parent changed C1's diaper, parent asked S1 if C1's diaper had been changed. After S1 informed parent that C1's diaper had not been changed, parent became upset and brought it to LT’s attention. LT said diaper checks typically begin after breakfast at 8:45am and continue through 9:45am. Diapers are again checked after lunch which is typically at 11:30am and again after children wake up from their naps between 1:00pm-1:30pm. LT said diapers are changed in between these times if a child's diaper becomes wet and or soiled.

LT said on 11/3/2021 at approximately 9:55am she began to put sweaters and jackets on C4, C5 and C6 who already had their diapers changed and got them ready to go out into the outdoor play area. C1, C2 and C3 remained inside with S1 and S2 to have their diapers changed. LT said at approximately 10:00am, C1, C2 and C3 were brought outside and had the expectation, and was under the assumption that C1, C2, and C3 had their diapers changed.

LT said five minutes later C4 had a watery bowel movement that went through the diaper and soiled his pants. LT said she asked S2 to change C4’s diaper while she called his mother. Once C4 was taken care of, LT said she began to comfort C3 during nap time who has been having a difficult time transitioning from the infant classroom into the toddler classroom. LT said C1 typically requires soothing during nap time, however, on 11/3/2021 LT said she noticed C1 nodding off to sleep. LT said at this time she stepped back to ensure all children had fallen asleep. LT said because C1 had fallen asleep on his own there was no need to sit next to him which resulted in LT not becoming aware of C1’s soiled diaper.

A parent interview conducted on 11/6/2021 and interview with Staff #2 on 11/19/2021 corroborates the information provided by the LT.

Based on interviews conducted and available information obtained, the preponderance of evidence standard has been met, and the allegation is therefore substantiated. An exit interview was conducted with Lead Teacher, Wanda Stephens, and the plan of correction was discussed, Notice of Operation in Violation of Law and appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.

The facility immediately put into place a binder with a separate section for each child to ensure diaper changes are made throughout the day as well as assigning primary caregivers for children in care.
