On 5/24/21 at 2:30 PM Licensing Program Analysts (LPAs) Monica Mathur and Michelle Sutton conducted an Unannounced Subsequent Complaint Investigation at Railroad Junction. LPAs met with Teacher Anita who informed that Owner/Director Lily Gupta had left for the day. LPAs explained the purpose of today’s investigation visit. The finding for the above allegation was delivered during the visit.

During the course of the investigation, LPAs inspected the facility, reviewed records, and conducted interviews. It was determined that on at least two occasions during day care hours, some children used their personal devices to interact with a stranger and physically exposed themselves in an inappropriate way. Supervising staff were not aware the incidents were happening under their supervision, did not notice children using their devices in the classroom and bathroom. They became aware only after some children self-reported to them few days later. Lack of supervision resulted in children participating in inappropriate activities which is an immediate risk to the health and safety of children in care. Licensee understands that staff should be providing active supervision such as physically walking around, interacting with children and visually observing their activities at all times.

On 5/24/21at 2:40 PM Licensing Program Analysts (LPAs) Monica Mathur and Michelle Sutton conducted an Unannounced Subsequent Complaint Investigation at Railroad Junction. LPA met with Teacher Ms Anita who informed that Owner/Director, Ms Lily Gupta had left the facility for the day. LPAs explained the purpose of today’s investigation visit. The finding for the above allegation was delivered during the visit.

During the course of the investigation, LPAs inspected the facility, reviewed records, and conducted interviews. It was determined that a child opened the bathroom door when another child was using the bathroom inside, resulting in that child being physically and visually exposed to other children who were sitting at a table outside the bathroom. Supervising staff responsible for the room were not aware of the incident, did not visually witness it happen and only became aware when some children reported it to them. Facility failed to provide safe, healthful and comfortable accommodations to children and which resulted in interference with toileting needs also. This is a violation of personal rights which poses an immediate risk to the health and safety of children in care. Licensee understands that staff should be providing active supervision such as physically walking around, interacting with children and visually observing their activities at all times.

Based on the interviews and information obtained throughout the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on 9099-D page for a Type A.

101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights:
(1) To be accorded dignity in his/her personal relationships with staff and other persons.
(2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs.
(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.
(4) To be informed, and to have his/her authorized representative informed, by the licensee of the law regarding complaints including, but not limited to, information on confidentiality and the address and telephone number of the Department's complaint unit.

Due to the issuance of a Type A Citation during today's inspection, a copy of this Licensing Report must be posted in the facility and given to each existing parent by the end of today or next day child is in care. Report also has to be provided to the parent of children who are enrolled over the next 12 months. In addition, a copy of the LIC 9224 Acknowledgement of Receipt of Licensing Reports must be signed by each parent and kept in each child's file.

Licensee was informed that a Non Compliance Conference with CCLD Management will be scheduled at a later date.

Exit interview was conducted with Ms Lily who authorized Ms. Anita to sign the report. Report, the deficiency, plan of correction, and appeal rights were discussed.

A NOTICE OF SITE VISIT WAS ISSUED AND MUST BE POSTED ON OR ADJACENT TO THE INTERIOR SIDE OF THE MAIN DOOR INTO THE FACILITY FOR 30 CONSECUTIVE DAYS.

Since the incidents, Licensee suspended use of personal tablets in the Center.BY 05/25/21 Licensee agreed to submit a written atatement of her understanding of the regulation and a plan how 100% visual supervision will be ensured.
