13 | Licensing Program Analyst (LPA) Diana Campos met with Director Carmela Asuncion-Santos for the purpose of a subsequent investigation visit regarding the above allegation.Present during this investigation were 9 staff and 48 children in care. During the course of the investigation interviews were conducted and records reviewed. Per interviews conducted on at least one occasion 5 or more children from the same classroom were observed to have runny noses with yellowish-greenish nasal muccus. Interviews revealed that when a child is observed to have a runny nose parent is required to have child cleared by doctor to determine that they are not contagious prior to returning to care. Facility's health policy states that a parent should not bring a child to school if the child or a family member is displaying symptoms such as cough, chills, headache, runny nose, congestion or sore throat. Based on information gathered it could not be determined if a child was allowed to stay while displaying the runny nose or if it developed during the course of the day. Staff interviews were contradicting regarding admin response to reporting illnes concerns. During the investigation, personal rights were discussed. Based on the investigative findings, there was not enough evidence to determine whether or not the administrator did not prevent the spread of illness. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur. Therefore, the allegation is unsubstantiated.
