On January 25, 2022 at 1:45pm, Licensing Program Analyst (LPA) Julia Placencia arrived unannounced to complete the complaint investigation regarding the allegation above. LPA met with director Jillian Miller. Present were 10 children and an additional 2 staff members. During the course of the investigation LPA interviewed director, former director Ruth Valdes and several teachers. It has been determined that in July 2020, EMSA approved CPR/First Aid cards were issued to staff without any training conducted. Former director admitted to LPA that she advised staff that training was not needed due to COVID and that training would be provided at a later date.

Based on observations, interviews and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22 is being cited on the attached LIC 9099D. Failure to submit Proof of Corrections (POC) by Plan of Correction date may result in additional civil penalties. Exit interview conducted with director Jillian Miller and copy of report provided. A Notice of Site Visit was provided and must be posted for 30 days.

Director will ensure she reviews this regulation and submit a statement of understanding. Additionally, director will ensure all invalid CPR/First Aid cards received in July 2020 are removed from staff files and are replaced with valid cards issued from an EMSA approved
vendor after successful completion of course.

This requirement is not met as evidenced by: Based on interviews and records review, EMSA approved CPR/First Aid cards were issued to staff without the required training. LPA may return on a later date to ensure compliance.

Failure to correct will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected.
