On 12/7/23 Licensing Program Analysts (LPAs) Monica Mathur and Brindha Govindasamy conducted an unannounced Required Inspection at East Bay Waldorf School. LPAs met with Director, Loveleen Dhillon and explained the purpose of today's inspection. Center operates in 2 rooms (Daisy and Apple Blossom) located in the premises of East Bay Waldorf School (K-7).

The physical plant was inspected with the Director.
INDOOR SPACE: Classrooms and restrooms were inspected. Facility was in compliance with teacher child ratios during inspection. Children were engaged in various activities under the visual supervision of the teachers. Disinfectants, cleaning solutions, and other items dangerous to the health and safety of children were stored in places inaccessible to them. Furniture and equipment were age appropriate and in good condition, free of sharp, loose, or pointed parts. Restrooms for children were observed to be in safe, sanitary and functioning condition. Floors were clean and free from tripping hazard. Foods and beverages were stored safely. Trash cans for solid waste had tight-fitting covers on and were in good repair. LPA observed a working Fire extinguisher, Smoke and Carbon Monoxide Detectors. Log shows that the last Fire Drill was conducted in September 2023. Facility does not provide transportation for children, but Director understands that children cannot be left alone, unattended in parked vehicles. Required postings were observed to be posted.
OUTDOOR SPACE was inspected and observed to be fenced and safe. Center has separate yards for each preschool room and the Early Childhood Common Area Playground used by both elementary and preschool program with separate schedules. Equipment was maintained in good condition and free of hazards. Areas around and under high climbing equipment were cushioned with material that absorbs falls. Shade is provided and there were no bodies of water observed. Drinking water is readily available to children.

FILE REVIEW: Children sign in/out procedures and logs were reviewed. Sample of children and staff files was taken for review. There was at least one teacher with current certification in Pediatric CPR/First Aid present at the facility during inspection. Children's Roster was reviewed. File review showed that all 8 employees including Director were not associated to the license. On further investigation it was determined some were separated in 8/2020 when center closed down during pandemic. Since reopening some were fingerprinted using an incorrect Live Scan form (used for elementary school associations), while some correct Live Scan LIC9163 forms were not filled out completely. LPA worked with Licensing office and transferred/associated 6 out of 8 employees during inspection. Due to most employees having working fingerprints or associations to other licensed childcare facilities, a Type B deficiency was cited today. Civil penalty assessed for $800 ($100 per person for 1 day). LPAs provided information for Guardian website.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

In the areas that were evaluated, regulatory violation was observed and civil penalties assessed. See page 809-D. Technical Violation Advisories were given for Child records and Mandated Reporter training. Exit interview conducted and report was reviewed by the Director, Loveleen Dhillon. A Notice of Site Visit was given and must remain posted for 30 days.

All 8 employees working at the center did not have associations to license. 2 out of 8 need Exemption Transfer or new Live Scan. Rest of the 6 have working clearances or were associated to another licensed childcare facility. This posed a potential risk to safety of children. LPA worked with Licensing office and associated the 6 (S3, S4, S5, S6, S7, S8) employees who had working fingerprints or associations elsewhere. Director will follow up on associations for the other 2 staff (S1, S2) who need to be re-fingerprinted. She agreed to submit proof of Live Scan no later than 12/14/23. Until then, S1, S2 shall not be permitted to provide supervision in the classrooms.
