Staff yells at daycare children.

On 11/18/21, at 12:15 PM, a closing complaint investigation visit was made to the facility by LPA Lynch. It has been alleged staff yells at daycare children, and daycare child was hit by another child in care. LPA met with the Center Director, conducted an interview, and discussed the allegations. Center Director stated staff do not yell at children, and children do not hit each other without staff intervening appropriately and denied the allegations. LPA observed adequate care and supervision during the LPA’s visits to the facility. However, interviews revealed disclosures of instances of staff yelling at children, and daycare children being hit by another child in care without staff intervening appropriately. Five additional current/former staff, several of who are also parents, and five children were interviewed on 09/29/21, 10/14/21, 10/22/21, and 11/04/21 during the investigation. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, Title 22 is being cited on the attached LIC 9099-D. Appeal rights were provided and exit interview conducted.

Center Director stated she will consult with DNCCC regarding appropriate preschool-level conflict resolution and intervention/prevention methods training for staff, and will provide a training description and signed statement by staff attesting completion of the training LPA by POC due date.

On 11/18/21, at 12:15 PM, a closing complaint investigation visit was made to the facility by LPA Lynch. It has been alleged parents are not allowed to visit daycare children due to covid. LPA met with the Center Director, conducted an interview, and discussed the allegation. Center Director stated staff do allow parents to enter the center with covid precautions such as masks, hand sanitation, temperature taking, and covid screening questions, and denied the allegation. Five additional current/former staff, several of who are also parents, and five children were interviewed on 09/29/21, 10/14/21, 10/22/21, and 11/04/21 during the investigation, and there were conflicting disclosures. LPA also observed a parent was allowed entry into the facility at an early pickup time during the investigation, and also during the closing visit. Based on interviews and observations, LPA did not find a preponderance of evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the finding is unsubstantiated. An exit interview was conducted, and appeal rights were provided.
