25 | Licensing Program Analysts (LPAs) Elvirs Sierra and Kristal Goodell met with Margaret for a Proof of Correction (POC) Inspection to clear Type A deficiency that was cited on 06/10/19, due to facility operating over capacity. Upon arrival LPAs observed 12 children present with Licensee and staff #1. Children, licensee and staff #1 were observed in the living room area. At approximately 10:54 AM a parent dropped off a child which increased census to 13 children present.
In addition, upon arrival LPAs observed an infant sleeping in car seat located in the living room with Licensee and staff #1 present. At approximately 10:20 AM LPAs observed infant was removed from the car seat and was awake. Due to child left in a car seat, asleep or awake, poses an immediate risk. This is a violation to Personal Rights of the children. Licensee acknowledged that a car seat restraint is for restraining children while being transported in a vehicle, not for any other use.
At 12:35 AM a child was picked up by parent which decreased census to 12 children. During inspection, LPAs toured all areas of the home both indoors and outdoors. LPAs also conducted observations. At approximately 1:20pm LPAs left facility and returned at 3:00pm. LPAs also reviewed files, licensing documents and learned one infant, preschool, and seven school age children were present. During inspection today LPAs learned that licensee's son had taken at least 2 additional children to El Dorado water park. The total number of children in care was 15 and that exceeds Licensee capacity of 14. Total number of children in care was at least 15, exceeding the license capacity of 14.
The ratio in License capacity is 14; therefore the facility was still over ratio and the citation was not cleared. As a result, the facility failed to follow the limitations of license which results in a failure to correct. Civil penalties assessed on 06/10/19..
Title 22 deficiencies cited on LIC 809-D. This facility evaluation report was reviewed and discussed with Licensee. A Notice of Site Visit was provided and should remain posted for 30 days. Upon receipt of Type A citations, licensee shall post and provide copies of the LIC 809-D for parents/guardians of children in care and for parents/guardians of newly and currently enrolled children for the next 12 months. Appeal Rights also issued and discussed. |
