Licensing Program Analyst (LPA) Elvira Sierra and Licensing Program Manager (LPM) Bettina Engelman conducted a complaint investigation and met with Licensee, Margaret McGeever to deliver findings on the above allegations. Upon arrival, present in the home were Licensee and Licensee's son caring for 14 children (1 infants, 7 Preschool, 6 School Aged).
It was alleged that an uncleared adult provided care and supervision to children. Record reviews and interviews were conducted with Licensee, Staff, Parents, children and Adult # 1. Based on interviews conducted and fingerprint record review, the licensee failed to ensure Adult # 1 was background check cleared or has an approved criminal record exemption prior to employment or presence in the home which poses an immediate health and safety risk to children in care. LPA learned that Adult # 1 had provided care and supervision to daycare children on at least one occasion prior to June 09, 2019. Licensee denied the allegation and stated that Adult #1 was not providing care and supervision to daycare children, but only worked at the facility occasionally as a housekeeper and volunteer sometimes.

Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following:

Licensee stated that children dont share wipes and that children use soap and water to wash their hands and if a wipe is provided, children get their own individual wipe. Licensee stated that she will make sure that assistants understand children cannot share wipes. LPA obtained a written statement from Licensee for her Plan of correction.

To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement was not met as evidence by; LPA learned from interviews that children would clean their hands with a wipe, which they then passed on to another child. This is a violation that poses a potential health and safety risk to children in care.

Licensee stated that Adult #1 is no longer employed at the facility. The Licensee understands all adults living or working in her home must have fingerprint clearances prior to residing or working in the facility. A civil penalty for $100.00 for Adult #1 was assessed today

The complainant also alleged that children were not provided a healthful environment. Rather than using soap and water, children were made to share wipes to clean their hands prior to eating. LPA learned from interviews that children would clean their hands with a wipe, which they then passed on to another child. This is a potential health and safety risk to children in care. Licensee denied that she let children share wipes, and explained that they are supposed to use their own wipes to clean hands. She said that siblings may have shared a wipe.

Based on LPAs interviews conducted and records review, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. See attached LIC 9099D page for deficiencies cited today under Title 22 Division 12 of the CA Code of Regulations. Civil penalties are being accessed. Licensee received and understood appeal rights.


Failure to correct deficiencies will result in a $100 per day civil penalty until corrected. Repeat violations are $250 per violation and $100 per day until corrected. Notice of Site Visit posted. An exit interview was conducted in which the report was reviewed and discussed with licensee.

Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 9099D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. The LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. (LIC 9224 is available on the website).
