On 5/19/23, Licensing Program Analyst (LPA) Joseph Pacheco and Licensing Program Manager (LPM) Juvenal Moctezuma conducted an unannounced complaint inspection. LPA and LPM met with Teacher Specialist (TS). Veronica Medina. The purpose of the inspection was to initiate an investigation and conclude the findings for the above complaint allegation.

During the course of the investigation, LPA and LPM interviewed day care staff. Based on the information obtained during the investigation and LPM observing children using both bathrooms simultaneously while staff were standing in the children’s cubby area which does not meet the requirement for children to be visually supervised at all times or for children to receive assistance while using the bathrooms, there is a preponderance of the evidence to prove facility staff did not adequately supervise day care children and facility staff did not ensure that day care children have access to water; therefore, the allegations are substantiated. The facility self-reported the incident which through information gathered during the course of the investigation it was confirmed that Child #1 was left outside unsupervised for no less 30 minutes which poses an immediate

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 9099 D). Licensee was provided a copy of their appeal rights.

LPA Joseph Pacheco informed Teacher Specialist, Veronica Medina that this report dated 5/19/23 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Joseph Pacheco informed the Teacher Specialist. Veronica Medina to provide a copy of this licensing report dated 5/19/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with Teacher Specialist, Veronica Medina.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Through interviews conducted it was revealed that the pitchers take a while to get refilled leaving the children without water to freely drink.
