On 02/23/2022, Licensing Program Analyst (LPA) Luisa Gavoutian conducted an unannounced complaint inspection to gather information and provide findings for the above-mentioned allegation. LPA met with Directors, Amy Conley and Crystal Eskelson, who accompanied LPA during tour of facility. LPA discussed the allegation and a census was taken. During the course of the investigation, LPA interviewed eight staff and made observations. All eight staff that were interviewed stated that children are encouraged to wear face coverings, if the child’s parent/authorized representative requests that their child wears a face covering. All staff stated that there are parents who do not want their children to wear masks and the facility maintains disposable masks on site, which are available to all children. LPA observed some children were wearing face coverings. LPA observed that all adults are wearing face coverings while indoors, regardless of vaccination status. LPA observed parents/authorized representatives entering the facility during drop-off and pick-up were wearing masks. On 12/20/2021, LPA observed some parents/authorized representatives who entered the facility without a mask and were reminded by facility staff to wear a mask. (Continued on LIC 9099-C)

LPA observed one parent/authorized representative who entered the facility to drop off their child and was not wearing a face covering. LPA observed that the facility Directors were engaged in other activities away from the front desk and were therefore unable to remind the parent/authorized representative to wear a face covering. LPA observed the parent/authorized representative proceeded to drop off their child without a mask on their face. LPA observed a box of disposable face masks available at the sign-in desk for parents/authorized representatives who forgot to bring their masks as well as a sign at the front door indicating that masks are required to enter the building. In summary, facility staff are encouraging some children to wear face coverings while indoors, all staff are wearing face coverings while indoors, and parents/authorized representatives are being reminded to wear face coverings when dropping off or picking up. Masks are available for all adults and children at the facility.

LPA provided Directors with a copy of PIN 21-29-CCP: Face Covering Requirements and Guidance for Child Care Providers Regarding Coronavirus Disease 2019 (COVID-19) issued on 11/23/2021, which notifies licensees and providers about updated guidance and requirements from the California Department of Public Health (CDPH) and Cal/OSHA which apply to all child care licensees, providers, and staff. This PIN also notes that CDPH has not authorized licensees, parents, or guardians to waive the child care face covering requirements.

The investigation revealed through interviews, LPA’s observations, and review of records, that although the above allegation may have happened or is valid, there is not a preponderance of evidence at this time to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, no deficiency is cited during today's visit.

An exit interview conducted with Directors, Amy Conley and Crystal Eskelson. A copy of this report and Appeal Rights were provided and discussed with Directors.
