On 11/7/2023, Licensing Program Analyst (LPA) Ka Vang conducted an unannounced Annual Required Inspection and was met by Jammie Milton, facility representative. Also present was a volunteer. Days and hours of operation are Monday through Friday, from 12:00 AM-12:00 PM. The home has a working telephone service and LPA confirmed the phone number is (559) 273-7917. Facility representative stated that the facility provides breakfast, lunch, and snack for the daycare children throughout the day.

LPA toured the home inside and outside. Census was taken and there seven daycare children present. Current facility sketch (LIC 999A) was reviewed, and facility representative confirmed that the daycare room, bedroom #4, hallway restroom are used for providing childcare and accessible to the daycare children. All other rooms are off-limits and made inaccessible to the daycare children by the used of plastic doorknob cover. There is a fireplace located in the living room but made inaccessible to the children by the use of a fire screen. Facility representative stated that there are no firearms in the home. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are inaccessible.

This is a two-story home there was a stair to the second floor. LPA observed the stair was not gated/fenced or barricaded as there are daycare children who are under the age of 5 years old present. LPA also observed a large pile of woods in the backyard that children have access. The home was not free from defects or conditions that might endanger a child; therefore, a deficiency was cited during today’s inspection. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There was no proof of fire drills been conducted and documented with the date, time and how many children present, every six months; therefore, a deficiency was cited during today’s inspection.

Safe toys and play equipment were observed and are in good condition, free of sharp, loose, or pointed parts. There is no animal in the home. The outdoor play area in the backyard is accessible to the children and is fenced. There is no swimming pool or other bodies of water on the premises.

Based on record review, the licensee did not comply with the section cited above. On 11/07/2023 at 12:30 PM, Licensing Program Analyst (LPA) Ka Vang arrived at the daycare home unannounced to conduct a required Annual Inspection and met S3, who she stated that she volunteers at the daycare home once or twice a week depending on if she is needed to assist with the daycare home. S3 stated that for today, 11/07/2023, S3 volunteer from 11:30 AM to 5:30 PM. S3 stated that she volunteers off and on at the daycare home for the past couple of months. During the arrival of LPA, S3 was supervising 7 children without the present of the licensee or an Assistant with a criminal record clearance or exemption. This poses an immediate health, safety, or personal rights risk to children in care.

During the physical inspection of the backyard, LPA observed a large pile of unused woods that children have access to the large pile of woods. During the unannounced inspection, Assistant Staff #2 (S2) and Volunteer Staff #3 (S3) were present with seven children. S2 stated that Licensee Staff #1 (S1) was not home as she was doing her internship with Visalia Unified School District in the beginning of school year 2023. S1 stated that she is interning Monday to Wednesday, 8:00 AM to 4:00 PM. Licensee temporary absences exceed 20 percent of the hours that the facility is providing care per day, therefore, this poses a potential health, safety, or personal rights risk to children in care.

During the inspection, LPA observed an adult who 18 year old was working in the home, but the adult did not obtain a criminal record clearance or exemption, or transfer his/her existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $500.00 maximum was assessed as this regulation was violated.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.



There are infants enrolled in the facility. Facility representative understands that there shall be one play yard for each infant in care, the play yard is kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the play yard. Infants are not swaddled while in care. Facility representative was not able to provide proof of physically checking on infants every fifteen minutes document any sign of distress, which includes but is not limited to flushed skin color, increase in body temperature, restlessness, and labored breathing on a sleeping log. A deficiency was cited during today’s inspection as facility representative was not able to provide proof of physically checking on infants every fifteen minutes. Facility representative understands that infants can be visually observed through an open door if sleeping in a separate room.

Facility representative ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. Capacity as specified on the license is being maintained.

LPA reviewed a sample of children’s files and observed files were complete with emergency information as required. Facility representative was not able to provide proof that staff #2 and staff #3 completed the Mandated Reporter training; therefore, a deficiency was cited during today’s inspection. Licensee’s pediatric CPR/First Aid expires on 04/2025. Facility representatives’ CPR/First Aid expires on 04/2025. A review of records indicates that Licensee and Staff #2 and Staff #3 have immunization records on file for influenza, pertussis, and measles. (Continued on LIC809-C).

LPA and facility representative discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.



Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, the following deficiencies are being cited during today’s inspection. (See next page, LIC809-D).

Upon receipt of a Type A violation, facility representative shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet-Child Care Parent Notification Requirements and a copy of LIC 9224 was given to facility representative.

Facility representative was provided a copy of appeal rights. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative. During the exit interview, facility representative, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.
