.On 05/04/23, an Informal Conference meeting was conducted today at the Fresno Regional Child Care Office. In attendance during this meeting was: Licensing Program Manager (LPM), Juvenal Moctezuma, Licensing Program Analyst (LPA), Araceli Gibson and Licensee, Dawna Massey. The purpose of the informal conference was to discuss previous citation, of personal rights of children in care regarding complaint that have occurred on 02/06/23. LPM Moctezuma reviewed and discussed the complaint with Dawna Massey, and how the Family Child Care Home will maintain compliance with the deficiencies cited below.

The Department of Social Services, Community Care Licensing Division has determined that Dawna Massey Family Day Care Home violated the following Title 22 licensing regulations:

04/20/2023 – TYPE A – 102423(a)(2) Personal Rights; (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. Based on multiple interview witness accounts, Licensee/staff did not ensure the personal rights of persons in care. Licensee uses unusual form of punishment on daycare children and was inconsistent in diapering/toileting needs to children in care.

12/08/22 – Technical Violation – Physical Plant - Technical Violation: 102425(a)(3) - Annual Inspection
– (a) There shall be one crib or play yard for each infant who is unable to climb out of the crib or play yard. (3) Mattresses shall be firm and covered with a fitted sheet that is appropriate to the mattress size, fits tightly on the mattress, and overlaps the underside of the mattress so it cannot be dislodged. LPA observed mattresses on play yards were shorter than the Graco Play Yard. Licensee stated the mattresses seem to slip within the sheet and the mattress.

12/20/21 – Technical Violation – 102417(g)(4)Annual Inspection ( g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (4) Poisons, detergents, cleaning compounds, medicines, firearms and other items which could pose a danger if readily available to children shall be stored where they are inaccessible to children. LPA observed a can of air freshener on the sink counter in the bathroom; LPA observed the hook and eye latch on the laundry room door was not secure and there were accessible bottles of laundry detergent and bleach on the ground. Licensee stated she was just in the laundry room, but the hook and eye latch is usually always in place. Licensee secured the latch during today's inspection. Licensee is reminded that all hazardous items, toiletries, and cleaning supplies should be kept out of reach of children at all times.

12/20/21 – Technical Violation - 102425(j)(5) - Annual Inspection The provider shall supervise infants while they are sleeping and adhere to the following requirements: (5) If the infant is sleeping in a separate room from where the provider is stationed, the door to the room the infant is sleeping in shall remain open at all times. LPA observed one infant asleep in a separate room with the door closed. LPA discussed with Licensee the requirement to keep the doors open when any infant, under 24 months, is asleep in a separate room, so that the provided can visually observe the infant without moving the door.

12/20/21 – Technical Violation - 102423(a)(2) - Annual Inspection (a) Each child receiving services from a family childcare home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. LPA observed Licensee, assistants, and children, not wearing face coverings.

12/20/21 – Technical Assistance - 102417(g)(5) - Annual Inspection (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fishponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. LPA observed a water table in the outside play area and recommended that Licensee store the water table on its side or upside-down or underneath the covered patio to prevent water from accumulating, especially with recent rainstorms.

11/05/2018 – TYPE B 1597.22 Immunizations (Employees/ Volunteers/ Assistants) Employees or volunteers at family day care home; immunization requirements; records; exemptions. Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Based on file review licensee didn’t have proof of pertussis and measles for Staff 1

Complaint of personal rights allegations

Complaint on 02/06/23 alleged

1. Daycare staff handled day care child in a rough manner – Unsubstantiated
2. Daycare staff uses unusual form of punishment with day care children – Substantiated
3. Child's diapering needs were not met -Substantiated
4. Denying food to children in care. – Unsubstantiated

Licensee has submitted plan of correction evidence for the above stated deficiencies.

COMPLIANCE PLAN
In response to these discussions, Licensee has agreed to the following:
1. Licensee will ensure children are provided with a safe and healthful environment, and comfortable accommodations furnishing, and equipment at all times.
2. Licensee has submitted the Family Child Care Online Orientation and submitted the certificate of completion to the Department on April 22, 2023. This plan of correction was to ensure that licensee is aware of community care licensing title 22 regulations and to help her get a better understanding of personal rights of children, and infant safe sleep and operation of a family childcare home to stay in compliance.
3. Licensee has updated communication process and procedures for toileting and diapering processes in the childcare home.
4. Community Care Licensing will increase frequency of site visits to the facility to monitor compliance.
5. Licensee agrees to comply with Title 22, Division 12, Chapter 3 of the California Code of regulations.

In addition, it was recommended that licensee connect with her local resource and referral agency for additional support and training. Licensee stated she already has contact information for her local resource and referral agency.

Today, Licensee was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. Furthermore, Licensee understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties.

A copy of this report was given to Licensee, Dawna Massey. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, No Deficiencies are cited during today’s Office Visit.
