A follow-up complaint inspection was conducted on 07/23/19 by Licensing Program Analyst (LPA) David Wilson. The licensee and assistant were supervising nine children, and operating within the licensed capacity and ratio requirements. No children were observed left in any parked vehicle. It was alleged that a child (C1) sustained unexplained injuries while in care including redness, scratches, and bruising with welts on the child’s buttocks.
A complaint inspection was conducted on 5/13/19. The licensee was interviewed and denied the allegation. The licensee stated that there has not been a child in care with an unexplained injury. Licensee stated that she would never hurt a child and spanking is never used as a form of discipline. Time-outs are used with older children (licensee and assistant stated not using the words time out and instead use the words "take a break" with older children), but infants are never disciplined. Licensee said that on 5/7/19 she and her assistant observed scratches and pinkness on the child's bottom when changing the child's diaper. The licensee denied seeing any bruising. The licensee stated she initially thought there may have been a diaper rash starting to form then realized it was from the child consistently scratching his bottom. On 7/8/19 a complaint inspection was conducted and the licensee’s assistant, S1, was interviewed. S1 stated that C1 cried the whole day (5/7/19). The licensee changed C1’s diaper around 7:30 am and said she saw scratches. S1 stated she never changed C1’s diaper. S1 stated she was not aware of anything that happened that could have caused bruises to C1.

On 06/07/19, LPA obtained and reviewed pictures of C1 taken on 05/07/19 that show skin discoloration that includes bruising, and scratches in various areas of C1’s buttocks. Medical reports were also obtained and reviewed, and it could not be determined what caused the marks on C1.

Interviews were conducted with children, parents and witnesses on 5/13/19, 5/21/19, 6/3/19 and 7/9/19. The interviews could not corroborate that children in care had ever been spanked or sustained any unexplained injuries.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted.
