32 | It was alleged that the fence is in disrepair; The On 4/26/21 at 3pm, Licensing Program Analyst (LPA) Snow conducted an announced complaint inspection and met with licensee/director Rose Mccutchen to discuss the allegations. At 1pm on 10/16/20 the Licensee used video to show the LPA the portions of the broken chicken wire fence near the bamboo, that the children had been climbing. The Licensee said there were already plans to repair the fence. The Licensee sent photos of the broken fence. 10 witnesses were interviewed, and the majority were aware of the broken fence and several were frustrated that it took so long to address, therefore the allegation is substantiated.
It was alleged that children are unsupervised; specifically, that children are able to climb fences or get around them into places in the yard where the teacher cannot properly supervise them. On 10/16/20 the Licensee said that one of the fences requires some repairs, which she completed within the same month. Licensee said kids have started making it a game to climb fencing and that she has been addressing it. She had a meeting with the staff on 10/3/20 and ongoing communications with staff to discuss strategies to prevent this. On 4/26/21 The LPA discussed the supervision issues with the licensee, Rose Mcchutchen who said they had thought they resolved the issue but after consulting with staff she determined that there is still an issue with children getting back into the off-limits bamboo.
The LPA conducted 10 interviews and 6 corroborated that allegation and felt the supervision problem was ongoing as follows: Children continually climbing a fence to get into off-limits area with the bamboo. Children pooping a few times and regularly peeing in the play yard. Staff can’t see into bamboo against the fence, can’t see around the bamboo in the middle of the yard, can’t see into cement dome. Staff appearing to be unable to redirect some of the children. A Witness observed staff exclaim that they did not realize the child had been inside the bamboo as they emerged, regular scratches and ouch reports from the off-limits area with bamboo.
Photos of the yard/fence, a copy of the staff schedule & contact numbers, a facility roster and the incident report for the injured child. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted. The Notice of Site Visit must be posted for 30 days. |
