On 03/07/2022, at 3:00 PM, a closing complaint investigation visit was made to the facility by LPA Lynch. It has been alleged child's authorized representative denied access to pick up the child from the childcare, and child's authorized representative denied information about the child's care . LPA met with the Site Supervisor, conducted an interview, and discussed the allegation. Site Supervisor stated a child's father attempted to pick up child from facility without the child's mother's permission. Former Site Supervisor had provided paperwork to LPA from the child's mother at a previous visit. However, interviews and documentation revealed there was no authorized court order explicitly prohibiting child's father from drop off and/or pick up of his daughter at the time, or prohibiting him from receiving his child's facility records. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22 is being cited on the attached LIC 9099-D. Appeal rights were provided and exit interview conducted.

Site supervisor stated that since the incident they have received an authorized restraining order from the court which LPA observed in the child's file. POC is cleared today at the time of visit.

(6) To request in writing that a parent not be allowed to visit a child or take a child from the child care center provided the custodial parent has shown a certified copy of a court order pursuant to Health and Safety Code Section 1596.857. This was not met as evidenced by there is no authorized court order in place prohibiting parental access to child at facility.

Site supervisor will review court order for stipulations regarding access/denial of child's records, and will review regulations at the staff meeting this week and email LPA meeting agenda/summary afterwards.
