13 | On 07/25/2022, at 9:30 AM, a closing complaint investigation visit was made to the facility by Licensing Program Analyst (LPA) Lynch. It has been alleged staff is not providing adequate supervision, specifically that on 5/17/22 two children (C1, C2) got out of the back gate and into the alley. LPA met with the Site Supervisor, conducted an interview, and discussed the allegation. Site Supervisor stated a child (C3) opened a back gate and ran outside of the facility to meet a teacher while another teacher was supervising them (S1, S2). Three staff were interviewed and one staff witness stated (S2) two children left through the gate and wasn’t sure if it was C1 or C2 who left, but stated the other child who left was C3. LPA found staff interviews had conflicting information regarding the children who were able to open the gate and leave, and which back gate had been opened by the children. Three parents (P1-P3) were interviewed and there were no disclosures of children leaving the facility, however, there was a disclosure of the shorter gate observed as left open. LPA observed both back gates during the visits and observed the shorter gate has a latch on it that can be reached by children at the facility and received prior photo evidence. It was also alleged the facility is operating out of ratio. The Site Supervisor, and Licensee/Owner both denied the allegation, and stated they maintain staffing ratios at the facility. Site Supervisor stated she is always in ratio as a teacher along with the other staff at the center when she is there, and on the day and incident in question, there were two addtional staff present besides her. Three staff (S1-S3), and three parents (P1-P3) were interviewed, and there were generally no disclosures. During the complaint inspection visits, LPA also observed the facility was within staffing ratios per Title 22 regulations. Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred, and the findings are unsubstantiated. An exit interview was conducted, appeal rights provided, and notice of site visit posted. |
