13 | On 05/04/2022, Licensing Program Analyst (LPA) Kiriko Lynch conducted a closing complaint investigation and met with the Licensee. It was alleged the Licensee is not safeguarding children's records, specifically regarding an individual picking up records on behalf of the Licensee. The Lead Teacher was interviewed 03/07/2022, and facility staff were also interviewed at the facility and at associated facility sites regarding the allegation on 03/07/2022 and on 05/04/2022. Interviews had conflicting information regarding the allegation, specifically what files the individual had access to and would pickup for the Licensee. The Licensee was also interviewed on 04/20/2022, denied the allegation, and stated only non-confidential paperwork is picked up, mainly in regards to staff accounting records. Licensee stated that the folder labeled with her name is the only file that is picked up, and the parent files are not the records of what the individual picks up. LPA observed the area in which the folder was kept for the individual to pick up for the Licensee and parent folders in the same general area. LPA observed parent folders were mostly empty of records, but several did contain parent copies of admission paperwork. Licensee stated she will also separate the Licensee pick-up folder from parent folders to prevent the confusion going forward. Based on interviews and records review, LPA did not find a preponderance of evidence to corroborate the allegation. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the finding is unsubstantiated. Exit interview was conducted, appeal rights provided, and notice of site visit posted. |
