On 7/21/23 at 10:33am, Licensing Program Analyst (LPA), Martha Malane conducted an unannounced annual inspection and met with Director, Bertha Uriarte and Site Supervisor, Isabel Garcia. LPA disclosed the purpose of the inspection and was led on a tour of the facility. This is a full-day program which operates year-round. Days and hours of operation are Monday – Friday 7:30am – 5:30pm. There were 16 children and two (2) teachers and two (2) aides present.

Furniture and equipment are in good condition. Playground equipment is in safe condition. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. High-climbing equipment has rubber cushioning to absorb falls. Toilet and hand-washing equipment are in safe and sanitary operating condition. Floors in the facility are clean and safe. Solid waste storage containers have tight-fitting covers and are in good repair. Drinking water is available both indoors and outdoors. Facility has a functioning carbon monoxide detector that met statutory requirements. The last fire/disaster drill was conducted and documented 4/3/23. Director stated there are no bodies of water on the premises. Director stated there are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions and other hazardous items are made inaccessible. No poisons were observed.

A review of staff records on this date indicates facility staff or other individuals who require caregiver background checks have not received criminal record and child abuse clearances or exemptions. At 12:50pm, during a record review, LPA observed that Staff 1 (S1) did not receive a criminal record clearance and was not associated to the facility; see LIC809D for Type A deficiency cited.

Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. Capacity and limitations as specified on the license are being maintained. At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. Children were under supervision, including visual supervision, of a teacher at all times. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. LPA reviewed a sample of staff files and observed files were complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA verified that the lead testing was completed as outlined in PIN 21-21.1-CCP.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, deficiency cited; see LIC809D for Type A deficiency cited.

LPA informed Director, Bertha Uriarte that this report dated 7/21/23 documents one (1) Type A citation on the attached LIC809-D, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed director to provide a copy of this licensing report dated 7/21/23 that documents a Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224), or other written statement, must be placed in the child's file for verification.
