LPA, Luigi Gargaro, conducted an unannounced inspection with the licensee. The two story home was toured and inspected to ensure an environment safe for the care and supervision of children per the standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. Present were the licensee, her helper daughter Amber Peres and two day care children. The fire extinguisher and combination smoke and carbon monoxide detector meet requirements and are operational. Most hazardous items were latched/locked and secured out of reach of children. The licensee was asked whether she had any weapons in the home and she replied no. A review of staff records on this date indicates that all adults or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. First Aid and CPR certifications expire on October of 2020 for the licensee and April of 2020 for her assistant Amber Peres. Children’s records were reviewed and were found to be in order.

Licensee has provided adequate space for the children to eat, sleep and play within the home. Areas used for child care include the day care room, the day care bedroom and the day care bathroom. Off limits areas include the kitchen, the family room, the living room, the dining room, and the two first floor bedrooms and are inaccessible through use of a secured, installed safety gate in the entrance way between the day care room and the kitchen that makes the back of the home inaccessible to children in care. The licensee also has a safety gate in place on the lower floor staircase. The licensee has sufficient toys and equipment available. The home has a fenced backyard that is not typically used for outdoor activities that contains a facility pool. The pool has been inspected and approved previously and meets gate and fencing requirements. The yard had no hazards upon inspection.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department.

The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm. LPA and licensee discussed California Megan's Law and he provided licensee with the website address: www.meganslaw.ca.gov for her to review information regarding her facility on a regular basis.

The following items were discussed with provider: information on child abuse reporting, children’s records, posting requirements, adults living or working in the home and civil penalties associated with this requirement, shaken baby syndrome, and SIDS. Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers are not allowed in day care.

Licensee was cited one type B violation today (see same day 809D deficiency page). Analyst printed a notice of site visit before leaving the facility and had licensee post it in her notice area.

Licensee corrected the deficiency during the visit when she reinstalled a latch on the cabinet that she has had in place previously and made the cabinet inaccessible once more.

This requirement was not meant when analyst found personal care items below the day care bathroom sink including razors, shampoos, etc. This was a potential risk to children in care as children present in day care were younger children who do not use the restroom yet.
