32 | Parent was not at the facility at the time of that inspection. The 14th child was supposed to be picked up up before the 15th child arrived, but parent had car trouble. Licensee admitted to having the 15 children and states she should have not accepted the 15th child.
Based on LPAs observations the preponderance of evidence standard has been met therefore the allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 3, is being cited on the attached LIC 9099D. See 9099-C for continuation.
LPA Gloria Gonzalez informed Licensee, Sandra Gonzalez that this report dated 6/15/22 with a Type A citation, CCR 102416.5(f) Staffing Ratio and Capacity, shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Licensee was advised to also give a a copy to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
LPA Gonzalez provided Licensee a copy of the Capacity Regulations for a Large FCCH and resource.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
A copy of this report, notice of site visit (LIC 9213), and appeal rights (LIC 9058) was provided to Licensee, Sandra Gonzalez.
LPA interpreted and explained the inspection report to licensee, licensee stated she understood.
An exit interview was conducted with Licensee, Sandra Gonzalez. |
