13 | On 03/28/21 at 11:30am, Licensing Program Analysts (LPA) Adrian Castellon and Claudia Amador conducted an unannounced inspection to deliver complaint findings for the above allegation. LPA Castellon met with licensee Margarita Aristoteles and discussed the purpose of the inspection. It was alleged that the licensee places children in unapproved child equipment. During the course of the investigation, two unannounced inspections were conducted. Interviews were conducted with day-care parents, facility staff, and day-care children. LPAs took pictures of the equipment.
Based on the licensee's admission, interviews, and the LPAs observation of the equipment present in the childcare area, the allegation is substantiated. Licensee placed children in unapproved child equipment (excersaucer). As such, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Violations of the California Code of Regulations, Tittle 22, are being cited on the attached LIC9099D. Final findings delivered as substantiated, a type ‘B’ violation is being issued, as the situation posed a potential risk.
