An unannounced Plan of Correction visit made by Claudia Amador, LPA, to follow up on deficiency cited on 09/21/2022. Assistant Noemi Mendez(NM) greeted LPA. There are six (6) children in care, two (2) infants and four preschool age. Licensee Margarita Aristoteles (MA) was not in the facility. LPA informed NM reason for the visit.

LPA conducted a tour of the backyard. Licensee MA arrived and met LPA in the back yard. No corrections have been made to the back yard. The pool continues to be accessible to the children in care. No additions to the pool or the fence were made to comply with the regulation as stated on the plan of correction. Images filed.

The LPA instructed the Licensee to immediately drain the pool. The Licensee was informed she must inform the department(call and in writing) of changes to the facility and grounds before alterations are made,which includes the pool, and making alterations to the fence to surround the pool. The Department will review the plan and consult with the licensee. Until the Department approves the plan the licensee may move forward with the alterations. The licensee stated she understood. LPA reviewed California Code of Regulation 102417(g)(5) with the Licensee. LPA provided forms needed to attach to the plan of changes to the facility and grounds. LPA reminded the Licensee's Reporting Requirements.

The Licensee failed to correct the deficiency on the due date therefore warrants a daily civil penalty of $100.00 from 9/22/2022 - 9/23/2022, total of $200.00.

The pool was drained today prior to the LPA leaving the facility. The Licensee corrected the deficiency today, 09/23/2022. Deficiency cited has been cleared.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report reviewed with Licensee, Margarita Aristoteles. Licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
