On 05/08/2023 at 1:20 pm, Licensing Program Analyst (LPA), Michelle Hood conducted an unannounced Annual Required Inspection and met with Licensee Rosa Avilan. LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee. There were eight children present in the facility during this inspection. The licensee accompanied LPA inside and out of the facility during this inspection. The off-limits areas are inaccessible through the use of door latches and safety gates. Per the licensee the operating hours are Monday through Friday from 5:00 am to 3:30 pm.

The fire extinguisher, smoke detector, and carbon monoxide detector met the requirements. All hazardous items were inaccessible to children. The licensee has toys, play equipment, and materials available. The licensee uses part of the backyard for outdoor activities. The licensee understands there must be direct supervision while outside. There was an empty above ground pool observed however, there was no water observed in the pool. There is a fence separating the children's play area from the empty pool; however, the pool area is accessible from an off-limit window. The licensee was reminded all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to the initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Licensee’s First Aid and CPR certifications expire on 06/2023. The licensee has required immunizations. Licensee completed Mandated Reporter Training on 04/11/2023. The facility roster is maintained and reviewed. LPA reviewed children’s files. The last fire and disaster drills were conducted and documented on 04/09/2023.

LPA discussed the safe sleep regulations with the licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. There is one crib or play yard for each infant who is unable to climb out of the crib or play yard. Cribs or play yards are free from all loose articles and objects. The licensee physically checks on sleeping infants every 15 minutes. An Individual Infant Sleeping Plan [LIC 9227 (3/20)] is maintained for each infant up to 12 months of age and shall be available to the Department for review. The licensee places infants up to 12 months of age on their backs for sleeping.

LPA discussed the following: Reporting Covid positive, suspected child abuse & neglect, maintaining children’s records according to regulation, and post required forms. The licensee was reminded corporal punishment, smoking, exersaucers, bouncy seats, walkers, jumpers, and/or similar equipment are not allowed in daycare. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov.

An exit interview was conducted and the report was reviewed with the licensee. The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. Notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Based on observation , the licensee did not comply with the section cited above in one out of one total count, the licensee did not ensure the pool area was fenced with no access fom the house which poses/posed a potential health, safety or personal rights risk to persons in care.

The licensee stated the pool will be removed no later than 05/14/2023. The licensee will send proof no later than 05/15/2023 to the LPA.
