On 08/03/2023, Licensing Program Analysts (LPAs) Candis Rodriguez and Pa Kou Vue conducted an unannounced Annual Required inspection at facility. LPA met with Director Vanessa Stewart, explained purpose of inspection, toured the facility, and took a census. Operating hours are Monday through Friday, 6:30am to 6:00pm.

There are no bodies of water. Firearms and other weapons are not allowed or stored on the premises of a childcare center. The childcare center is clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees, and visitors. In combination programs, outdoor activity space provided for school-age children is physically separate from space provided for infant care and childcare center children.

LPAs observed scissors and large flathead screwdriver on a counter accessible to children in care. Licensee immediately removed items and placed in an inaccessible area. No poisons were observed. Furniture and equipment are in good condition, free of sharp, loose or pointed parts. All toilets, hand washing, and bathing facilities are in safe and sanitary operating condition. All floors are clean and safe. All kitchen, food preparations and storage areas are kept clean, free of litter, rubbish, and free of rodents and other vermin. All storage containers for solid waste, including moveable bins, have tight-fitting covers that are kept on, and in good repair. Uncontaminated drinking water is readily available both indoors and out. Outdoor activity space surfaces are free of hazards. The areas around or under high climbing equipment, swings, slides and similar equipment are cushioned with material that absorbs a fall. The facility maintains compliance with staff-child ratios. Menus are posted where an authorized representative may view them. Facility has one or more functioning carbon monoxide detectors that meet statutory requirements.

Based on observation, the licensee did not comply with the section cited above as a pair of scissors and a large flathead screwdriver were accessible to children in care which posed a potential health, safety or personal rights risk to persons in care.

There is a separate, complete, and current record maintained for each child enrolled in the childcare center. Each child's record contains a medical assessment. A licensee's failure to comply with the department’s exclusion order after being notified of the order shall be grounds for disciplining the licensee. The department has inspection authority as specified in Health & Safety Codes. The department shall notify a licensee to remove/bar any person with specified convictions or for other reasons. The licensee shall comply with the notice. The licensee shall not exceed the approved capacity of the fire clearance for the facility. No child(ren) shall be left without the supervision, including visual supervision, of a teacher at any time. Prior to working or volunteering in a licensed childcare facility, all individuals subject to criminal record review have obtained a clearance or criminal record clearance or exemption.

Incidental Medical Services (IMS) are currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. Information regarding Americans with Disability Act (ADA) can be obtained by contacting US Department of Justice toll free ADA Information line at (800) 514-0301(voice), (800) 514-0383 (TDD) and website link https://www.ada.gov/childqanda.htm.

Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Assembly Bill 2370, Chapter 676, Statutes of 2018 requires all Child Care Centers (CCCs) that are located in buildings constructed before January 1, 2010 to test their drinking water for lead contamination by January 1, 2023 and every 5 years thereafter. This facility has provided evidence of completed water testing.

To improve the quality and value of the new inspection process, a survey will be sent to the email address provided. Please complete the survey and share your inspection experience. LPA and Director discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D). Licensee was provided a copy of their appeal rights.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
