On 11/30/2023, Licensing Program Analyst (LPA), Lady Cabrera conducted an unannounced Required Inspection and was met by licensee Luz Urena. Also present was licensee’s husband/assistant and licensee’s adult son. Licensee is Spanish Speaking. Days and hours of operation are Monday through Sunday but less than 24 hours.

LPA toured the home inside and a census was taken. Licensee confirmed that the living room, dining room, kitchen, bathroom, bedroom #1, bedroom #2, and fenced back yard was made temporarily inaccessible to day-care children. Licensee reported that there are tools, glass door and cement bags that will be used for construction for this coming weekend. All other rooms are off-limits and made inaccessible by doorknob spinners.

There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition on the premises. No poisons were observed during the inspection. Detergents, cleaning compounds are made inaccessible.

During the inspection in the kitchen, LPA Cabrera asked Licensee to open the unlocked top drawer of the kitchen cabinet. LPA observed small coins, white tablets (medicine), and small bag of marijuana. The Adult #4 confirmed to LPA that it was marijuana. Two infants and two small children were present, and the kitchen was an accessible area to the children. Licensee immediately removed medicine and hazardous items.

During the tour of Bedroom #2, LPA Cabrera observed Child #4 sleeping on the bed in Bedroom #2. Licensee reported the bedroom and bed belongs to her adult son. LPA asked if Licensee provided clean sheets for Child #4. Licensee answered no. Licensee did not provide safe and healthful accommodations for Child #4.

There is one fireplace in the home located in the living room and is made inaccessible by a child’s safety gate and will not be in use during daycare hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort.

Based on observation and interview, the licensee did not comply with the section cited above. LPA Cabrera asked Licensee to open the unlocked top drawer of the kitchen cabinet. During today's inspection, Licensee reported her adult son (Adult #3) turned 18 years on September 28, 2023, and he still lives in the home. Adult #3 is not background cleared with CCL, which poses an immediate health, safety or personal rights risk to persons in care.

Licensee stated she will ensure Adult #3 undergoes live scan processing in order to obtain background clearance. Licensee scheduled the live scan appointment for 12/01/2023 at 12:00 p.m. Licensee stated she will submit proof of live scan to the Fresno Community Licensing (CCL) office by 12/01/2023.

This is a single level home and there are no stairs. Safe toys and play equipment are observed. The home has working telephone service and LPA confirmed the phone number is (661) 364-8888.

Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Capacity as specified on the license is being maintained.

LPA reviewed a sample of children’s files and observed files were complete with emergency information as required. Licensee’s Mandated Reporter Training was completed on 07/12/2022. Licensee’s pediatric CPR/First Aid and tuberculosis for self and Staff #2 at the facility.

LPA discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to resources such as forms, regulations Provider Information Notices (PINs), and Quarterly Updates. LPA discussed Reporting Requirements as outlined in the regulations (Section 102416.2).

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated. During today's inspection, Licensee reported her adult son (Adult #3) turned 18 years on September 28, 2023, and he still lives in the home. Adult #3 is not background cleared with CCL. Licensee scheduled the live scan appointment for 12/01/2023 at 12:00 p.m.

LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Licensee was reminded of the importance of the documenting the 15-minute checks for all infants.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Exit interview conducted and report was reviewed with licensee Luz Urena. During the exit interview, the licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA verified the RSO profile in FAS.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited on LIC809D. Licensee was provided appeal rights.

Upon receipt of a Type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 Acknowledgement of Receipt of Licensing Reports was given to Licensee Luz Urena.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
