On 12/01/2022, Licensing Program Analyst (LPA) Jessika Thompson conducted an unannounced annual inspection. LPA met with Licensees Guadalupe and Maria Hidalgo. A tour of the home was conducted, and a census was taken. Current facility sketch reviewed, and Licensees confirmed the front living room, the step down living room, the dining/kitchen area, the patio play area, and the hall bathroom are used for providing care and are accessible to day care children. All other rooms are off-limits and are made inaccessible by use of spinner knobs, and safety gates. The backyard is off limit and inaccessible to children. Medications and other hazardous items were inaccessible to children. The fireplace located in the living room was made inaccessible to children by an iron screen and will not be used during day care hours. The fire extinguishers, smoke detectors, and carbon monoxide detector met Community Care Licensing regulations. Heating/cooling and ventilation was sufficient for safety and comfort. There were no stairs in the home. LPA observed an infant rocker and exersaucer within day-care areas. LPA advised Licensees that exersaucers and infant rockers are not permitted for usage in family child care homes. Adequate supervision was being provided during this inspection. There is one crib or play yard for each infant in care, cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard. Infants are not swaddled while in care. Licensees have not been completing fifteen minute sleeping logs for infants in care. Licensees were advised that they must log each fifteen minute check, documenting any signs of distress, which includes but is not limited to: flushed skin color, increase in body temperature, restlessness and labored breathing. Infants can be visually observed through an open door if sleeping in a separate room. Individual Infant Sleeping Plan is on file for Child #1 & Child #5 as required; however, Child#3's file does not contain an Individual Infant Sleeping Plan. Infants up to 12 months of age are placed on their backs for sleeping.

Licensees are aware that children shall not be left in parked vehicles and is aware that car seats are used for transportation purposes only and are not used for sleeping children. Licensees have 2 small dogs that are accessible to children. Licensees are aware of child safety around pets and accepts responsibility for any action taken by pets. There were no firearms on the premises (continued on LIC809-C).

A sample of children’s records contained all emergency information specified by regulation; however, children's files were missing California Child Immunization Records (PM286). Licensee Guadalupe Hidalgo completed Mandated Reporter Training on 8/22/2022. Licensee Maria Hidalgo completed Mandated Reporter Training on 8/22/2022. Both licensee's pediatric CPR and First Aid expires on 9/11/2023.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA and Licensees discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms, and Regulations.

Hours of operation are Monday through Friday 6:00 AM to 6:00 PM and other hours as arranged.

Per Title 22, Division 12, Chapter 3 of the California Code of Regulations, the following deficiencies were found: (see LIC809-D)

Based on record review, the licensee did not comply with the section cited above, as Licensees stated they have not been logging each 15-minute check for Child #1, Child #3, and Child #5 as required. This poses a potential health, safety or personal rights risk to persons in care.

LPA reviewed safe sleep regulations with licensees in detail. Licensees removed the infant rocker and exersaucer from the home today and agreed to forgo usage. Licensees understand that infant rockers, exersaucers, portable nappers, baby walkers, and bouncers are not permissible for usage in family child care homes. Deficiency cleared during inspection.

Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.
