On 03/28/2023 Licensing Program Analyst (LPA) Beneroso conducted an unannounced subsequent investigation to deliver the findings for the above allegations. LPA met with licensee who guided LPA on a tour of the facility. Upon arrival, LPA observed 10 children in care with 1 staff members providing care and supervision.

The investigation consisted of interviews with staff, parents, review of facility roster, and other pertaining documents related to the complaint investigation. During interviews conducted, it was revealed that facility remains in ratio by limiting the capacity and occupancy of rooms and by rotating qualified staff, if needed.

During the investigation, it was also revealed that staff ensure the temperatures are comfortable for children. Several statements obtained through confidential interviews from relevant witnesses indicate the temperature inside the gym is kept around 68 and 70 degrees. Facility keeps adequate and comfortable temperature and at no time the children in care are place in any harm or discomfort.

Based on the information obtained, there were no witnesses that could corroborate the above allegations occurred; therefore, the allegations are deemed to be unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
