On December 5, 2023, an Informal Office Meeting was conducted at the Fresno South Regional Child Care Office. In attendance at the meeting were Licensing Program Manager (LPM) Luisa Gavoutian, Licensing Program Analyst (LPA) Kari McWilliams, and facility Director Lori Rogowski.

The purpose of this meeting was to discuss a recent violation of Title 22 regulations.
The following issue/violation was discussed:

Type A Deficiency:
101229(a)(1) Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time.

On November 1, 2023, Director, Lori Rogowski called into the Fresno South Regional Office to report an incident that occurred on October 31, 2023. Director Rogowski reported that Child #1 (C1) was left unattended in the outside play area for “at least ten minutes”. It was reported that a parent notified staff of the child outside and staff immediately brought the child into a classroom. Parent of C1 was immediately notified of the incident. C1’s teacher was immediately let go from the facility. It was reported that C1 was hiding behind a play kitchen and that is why the child was not seen when the children were brought back into the classroom. Director Rogowski has since removed all play kitchens from the outside play area and Director Rogowski also trained staff on the facility’s policies for transitioning from inside to outside and back into the classrooms as well as having an updated list of the students present. Director Rogowski also implemented a new procedure for designated staff to complete another visual sweep of the outside play area after the children have lined up to go inside as an extra precaution.

On November 3, 2023 LPA McWilliams conducted an unannounced case management inspection and met with Director Rogowski, the facility was cited a Type A deficiency and issued an immediate civil penalty for violation of 101229(a)(1).

Today, Director Rogowski and LPM Gavoutian discussed the steps the facility has taken to prevent this situation from occurring again which includes training existing staff and newly hired staff on supervision and transitioning periods.

Director Rogowski was reminded that facility staff are required to ensure that the health, safety, and personal rights of children in care remain protected at all times. It was discussed that continued violations of Title 22 Regulations may result in a Non-Compliance meeting or a possible referral of the childcare facility to the Legal Division for possible Administrative Action.

Exit interview conducted with Director Rogowski. Per Title 22 Division 12 Chapter 1 of the California Regulations no deficiencies are being cited today. A copy of this signed report was provided to Director Rogowski.
