On 2/4/2022, Licensing Program Analyst (LPA)Theresa Marquez conducted a complaint inspection and met with Licensee/Administrator Hayley Simon. LPA Marquez toured the center, took a census, and discussed the above allegations with Simon.

During the 1/12/2022 initial complaint inspection, LPA Marquez observed 19 children present of which 2 were wearing face mask. Today, 2/4/2022, LPA observed 22 children present, of which 1 was wearing a face mask. Statements made staff revealed that the staff are not enforcing nor encouraging children to wear face mask while indoors.
Staff were using an all purpose cleaner to sanitize. The all purpose cleaner is not a disinfectant and not antibacterial.

Based upon LPAs observation and information gathered during interviews, the preponderance of the evidence standard has been met, therefore the allegations that COVID-19 masking protocols are not being followed and the facility is not being properly sanitized is found to be substantiated.
Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiencies were found. See the attached LIC9099-D.
An exit interview and copy of Licensee's Appeal Rights was provided to Hayley Simon today.

Licensee/Administrator notified parents by posting a notice on the exit door that the preschool is required to comply with CDSS and CDPH requirements for children 2 and older to wear face mask upon entering into the building.

This requirement was not met as evidenced by observation and interviews conducted. On 1/12/2022 and 2/4/2022 LPA observed the majority of children present not wearing face mask while indoors and staff were not enforcing nor encouraging children to wear face mask while indoors. This poses a potential risk to the health, safety or personal rights to children in care.

Staff have discontinued using the Simple Green cleaner. All staff will use only disinfectant, antibacterial cleaners. DEFICIENCY CLEARED
