On 07/26/2023, Licensing Program Analyst (LPA) Candis Rodriguez conducted an unannounced case management inspection at facility regarding an incident that occurred on 07/12/2023. LPA met with Site Supervisor (SS) Ana Gutierrez, explained purpose of inspection, toured facility, and took a census.

On 07/12/2023, Child #1 exited Classroom #1 alone and was standing between Classroom #1 and Classroom #4, when a parent and Aide #1 saw Child #1 and immediately returned Child #1 to their classroom. LPA interviewed Teacher #1 who was present in Classroom #1 at time of incident. It was estimated Child #1 was alone for at least 30 seconds, up to two minutes based on prior interview with Director Rosalva Banuelos. Child #1 was unharmed and parents were notified.

Director and SS stated facility ordered safety gates to place at the entrance into the classroom to ensure this does not happen again. Facility staff also received a training on safety and zoning in the classroom to maintain full visibility of all children in the classroom at all times.

LPA observed the facility has fencing on the perimeter, as well as individual areas within the perimeter are fenced as well. LPA observed the fencing to be within regulation standards, with the exception of the fence right next to Classroom #4, which has a gap wide enough that a small child may be able to fit through. LPA advised facility to add another post to the gap which will ensure no one can fit through it.

Based on observation, interview, and record review, it was determined Child #1 was left without visual supervision which is a violation of regulations. (Continued on LIC 809-C)

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (See LIC 809-D). Licensee was provided a copy of their appeal rights.

LPA informed SS that this report dated 07/26/2023 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA informed SS to provide a copy of this licensing report dated 07/26/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
