On 5/26/2022 Licensing Program Analyst (LPAs) Jessika Thompson and Stephanie Vega Gonzalez conducted an unannounced Annual Required Inspection. LPA was met by Licensee Maria Picos De Garcia. Also present was Staff #1 (S1). Licensee is Spanish Speaking and LPA Stephanie Vega Gonzalez assisted with language interpretation. Days and hours of operation are Monday through Sunday from 4:30AM -10:00PM.

LPA toured the home inside and outside and a census was taken. Upon entry, LPA observed an awake infant sitting within a baby bouncer. LPAs also observed an additional vacant baby bouncer within the day-care room, as well as a vacant excersaucer. LPAs advised Licensee that exersaucers and baby bouncers are not permitted for usage inf family childcare homes. Licensee removed all three items during today’s inspection. Licensee’s current facility sketch was reviewed, and Licensee confirmed that the day-care room, kitchen, and adjacent restroom are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible by use of safety gates and spinning doorknob covers. Swimming pool is fenced per regulation. The pool gate is self-latching, self-closing and opens away from the swimming pool. No windows or doors have direct access to the pool area. There are no firearms or ammunition on the premises. All poisons are kept in a locked storage area. No poisons were observed during the inspection. Detergents, cleaning compounds, medication and other hazardous items are made inaccessible. The fireplace located in the day-care room is made inaccessible by a screen and will not be in use during day-care hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. There are no stairs in this home. LPAs observed a playhouse in the facility’s backyard with a tattered roof. LPA advised Staff #1 to ensure that all play equipment is safe and does not contain tattered edges or broken pieces. The home has working telephone service and LPA confirmed the phone number is (661)746-0169.

There is one crib or play yard for each infant in care, cribs and play yards are kept free from all loose articles and objects while infants are sleeping, and there are no objects hanging above or attached to the crib or play yard (see next page, LIC809C).

Infants are not swaddled while in care. Provider physically checks on sleeping infants every fifteen minutes and documents any signs of distress which includes but is not limited to flushed skin color, increase in body temperature, restlessness and labored breathing. Infants can be visually observed through an open door if sleeping in a separate room. LPA advised licensee that an Individual Infant Sleeping Plan must be completed and in file for each infant up to 12 months of age. Infants up to 12 months of age are placed on their backs for sleeping.

Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. The outdoor play area in the backyard is fenced. Capacity as specified on the license is being maintained. Records review revealed that licensee has not completed a fire and disaster drill since 2/12/21. LPA reviewed a sample of children’s files and observed files were complete with emergency information as required; however, 4 of 4 children’s files reviewed did not contain completed PM286 California School Immunization Records. Licensee’s Mandated Reporter Training was completed on 5/14/2021. Licensee’s pediatric CPR/First Aid expires on 5/15/2023. A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis and measles.

All adults who reside or work in the home have a criminal record clearance or exemption. There are no excluded individuals present at this home. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) are not currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations (see next page, LIC809C).

Based on LPAs observations, the licensee did not comply with the section cited above, as upon entering the facility LPAs observed an awake infant sitting within a baby bouncer. Licensee removed infant from the baby bouncer when asked to do so by LPA during today's inspection. Licensee removed both bouncers and exersaucer from the day-care room and placed them in an off-limit area. Licensee stated that this equipment will be removed from the family child care home permanently (FCCH) today. Licensee stated that she understands that bouncers and exersaucers are not permitted for usage in FCCHs. LPAs provided a safe sleep handout and discussed content with licensee. Deficiency cleared at visit.

Operation of A Family Child Care Home

Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. Licensee stated that she will conduct and document a fire & disaster drill by 6/10/2022. Licensee stated that she will continue to leave her fire and disaster drill log posted on her Parents' Board to serve as a visual reminder of the requirement. Licensee will submit a copy of the completed fire and disaster drill to the Fresno Community Care Licensing Office by 6/10/22.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, LIC809 D). Licensee was provided a copy of appeal rights.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee.

LPA Thompson informed Licensee that this report dated 5/26/2022 document Type A citation. Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Thompson informed the licensee to provide a copy of this licensing report dated 5/26/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
