An unannounced case management inspection was conducted today by Licensing Program Analyst (LPA) Caroline Harris. LPA met with licensee, Kimberlie Schmidt and a census was taken. LPA toured the facility. The purpose of this report is to cite violations which were discovered during the inspection.

Upon arrival, the LPA observed 12 day care children. There was three infants, four toddler age children and 5 school age children that she was supervising by herself. The LPA observed one infant to be sitting in a car seat on the floor and another empty car seat on the living room floor accessible to children. During the inspection, the LPA observed keep out of reach items in kitchen drawers (sharp scissors, sewing pins) where the child proof devices were not working and on the bathroom counters and under the bathroom sink (shampoos, cleaning supplies) that were accessible to children. The LPA further observed inaccessible rooms to have door spinners on the outside knobs but they were open and accessible to children. Also during the inspection, the licensee sent five children to the master bedroom, which is not licensed as a room to use and is to be inaccessible to children.

"Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months." The licensee was provided a copy of the "Fact Sheet" for AB 633 (Parent Notification Requirements), along with a copy of the relevant documents this date. A completed signed copy of the LIC 9224 will be placed in each child's file.

Per California Code of Regulations, Title 22, Division 12, Chapter 3, this deficiency is being cited on the attached LIC 809D.

Exit interview was conducted with licensee. A copy of this report and appeal rights were discussed and provided to licensee. A Notice of Site Visit Form was posted to parent’s board and must be posted for 30 days.

Operation of a Family Child Care Home. The home shall provide safe toys, play equipment and materials. This requirement is not met as evidenced by the LPA observing one infant age child sitting in a car seat in the living room. This poses an immediate risk to the health, safety, or personal rights of children in care.

Licensee was informed that car seats are not allowed in the facility and must be inaccessible to children. Licensee removed the infant from the car seat and placed the car seat in an off limits room. Safe Sleep requirements were reviewed with the licensee.

Staffing Ratio and Capacity. For a Large Family Child Care Home, the maximum number of children for whom care may be provided at any one time when there is an assistant provider in the home, including children under age 10 who reside at the licensee's home and the assistant provider's children under age 10, shall be either: More than twelve and up to fourteen children only if the criteria in Section 1597.465 of the Health and Safety Code are met.

Licensee's assistant arrived during the time LPA was present. Licensee will write how she will stay within ratio by not having more than 8 children present without an assistant. Licensee will have this available for review by 8/16/19.

If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c). This requirement is not being met as evidenced by observation of the licensee having 12 children present, 3 infants, 4 toddlers and 5 school age children that she was supervising by herself. This is an immediate risk to the health, safety or personal rights of children in care.
