On February 27, 2025, Licensing Program Analyst (LPA), Paul Garcia conducted an unannounced 3 year Required Inspection and was met by Licensee, Anastacia Pallares. Also present was/were Staff #1 (S1). Licensee is Spanish Speaking and S1 assisted with interpretation. Days and hours of operation are Monday – Sunday from 6:00 AM – 10:00 PM. The home has working telephone service and LPA confirmed the phone number is (562) 513-9681.

LPA toured the home inside and outside and a census was taken. A current facility sketch was reviewed and Licensee confirmed that kitchen, bathroom formal living room, large play room and back yard play area are used for providing care and are accessible to children. All other rooms are off-limits and made inaccessible by use of child safty gates and door spinners. The outdoor play area in the backyard is fenced. During the inspection of the back yard, LPA observed a portable play structure close in proximity to the pool fence creating a foothold that could enable a child to climb over the rod iron fence eliminating any barrier to prevent a child from entering the body of water (Pool). Also observed was a mop bucket unattended accessible to children in care containing approximately three (3) gallons of water.

There are two (2) medium sized dogs and four (4) chickens that reside in the back yard. Licensee understands the liability of pets around day care children and accepts responsibilities of any action taken by pets.

There is a pool located in the back yard, but it was out of compliance with AB2866 - The Pool Safety Act. Licensee was advised and provided documentation informing her that effective January 1, 2025, all childcare facilities licensed by CCL by law will be required to adhere to AB2866 - The Pool Safety Act. According to Health & Safety Code 1596.814, additional safety features will be required, which are listed in AB2866. During the inspection the homes kitchen cabinet under the sink's child safety lock was unsecured containing a variety of hazardous liquids to children in care including a bottle of 409 multi-purpose surface cleaner, a can of wood oil furniture polish, ArmorAll tire shine, and an can of Kilz Upshot Interior Primer which poses an immediate health, safety or personal rights risk to persons in care.

LPA did verify swimming pool is fenced per regulation. The pool gate is self-latching, self-closing and opens away from the swimming pool. No windows or doors have direct access to the pool area. Per licensee, there are no firearms or ammunition on the premises. During the inspection, LPA observed the homes kitchen cabinet under the sink to have its child safety lock unsecured containing a variety of hazardous liquids to children in care including a bottle of 409 multi-purpose surface cleaner, a can of wood oil furniture polish, ArmorAll tire shine, and a can of Kilz Upshot Interior Primer.

The fireplace located in the formal living room and is made inaccessible by a screen and will not be in use during daycare hours. There is a working fire extinguisher, smoke detector, carbon monoxide detector and adequate heating and ventilation for safety and comfort. This is a two story residence and LPA observed Stairs are fenced or barricaded when children under age 5 years old are present. Safe toys and play equipment are observed.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee ensures that children in care are supervised at all times and is aware children shall not be left in parked vehicles. Car seats are used for transportation purposes only and are not used for sleeping children. Capacity was observed out of compliance. Upon entry to the home, LPA observed eleven (11) children in care which two of the 11 were infants with only one qualified adult staff on site providing care and supervision.

LPA reviewed a sample of children’s files and observed files were not complete as required absent of children immunizations and many documents absent of being complete. Staff files were found to absent of required documentation.

Licensee’s Mandated Reporter Training was completed on February 28, 2023. Licensee’s pediatric CPR/First Aid expires on January 12, 2023, however During the inspection LPA observed S1 return from transporting children to school. During staff file review it was determined S1 had an expired CPR certification which

placed her out of compliance as she was and has been alone transporting children in care.

A review of records indicates that all employees and/or volunteers have immunization records on file for influenza, pertussis and measles.

All adults who reside or work in the home have a criminal record clearance or exemption.

There are no excluded individuals present at this home. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) are not currently being provided. (Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiencies are being cited: (see next page, 809 D)

LPA (Paul Garcia) informed licensee Anastacia Pallares that this report dated February 27, 2025, documents (three (3) of Type A citations. Type A citations which shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Paul Garcia informed the licensee Anastacia Pallares to provide a copy of this licensing report dated February 27, 2025, that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

This report shall be made available to the public upon request.

An exit interview was conducted, and this report was reviewed with the facility representative Anastacia Pallares. During the exit interview, the Licensee confirmed that there are no Registered Sex Offenders living in the home.

A notice of site visit was issued and must remain posted for 30 days.
