On 05/03/2023, Licensing Program Analyst (LPA) Candis Rodriguez conducted an unannounced complaint inspection at facility. LPA met with Director Barbara Sibrian, explained purpose of inspection and took a census.
Investigation revealed that staff were present and witnessed Child #1 scratch Child #2 on the face while both children were inside the outdoor play structure tunnel, and staff immediately intervened. Based on interviews with multiple staff, Reporting Party, and Site Supervisor, and record review, it was determined the incident did occur facility and Child #2 was injured by Child #1.
Therefore, the preponderance of evidence standard has been met, and the allegation is found to be Substantiated.
Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiency is being cited: (see LIC 9099-D). Site Supervisor was provided a copy of the appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

On 05/03/2023, Licensing Program Analyst (LPA) Candis Rodriguez conducted an unannounced complaint inspection at facility. LPA met with Director Barbara Sibrian, explained purpose of inspection and took a census.
Investigation revealed that Child #1 does have a Behavior Support Plan in place and facility staff are aware and trained to assist Child #1, including shadowing while playing around other children. LPA obtained copies of Behavior Support Plan as well as a Case Conference Report. Based on interviews with multiple staff and record review, facility had adequate staff members supervising children, were within ratio, and all were positioned strategically around the play area at time of incident.
Based on interviews conducted and documents reviewed, investigation could not reveal that Staff do not properly supervise day care children. Therefore, although allegations above may have happened or are valid, there is not a preponderance of evidence to provide the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.
Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, no deficiencies cited. Site Supervisor was provided a copy of the appeal rights. Facility had a Behavior Action Plan in place prior to and at time of incident. Facility has held follow up conferences with staff and other involved parties to discuss protocols to ensure the health and safety of all children, as well as support planning for Child #1.

Based on interview and record review, it was determined that Child #2 was injured by Child #1. This poses a potential risk to the health, safety, and personal rights of children in care.

LPA obtained copies of these plans and Site Supervisor stated facility will continue to reassess support plans as often as necessary, and continue to shadow Child #1. POC cleared today, 05/03/2023.
