32 | At times it was observed that there was no supervision during the transition between outside and inside, specifically while children walked though from the outside to the room at the back of the facility that has multiple storage cubbies. The Information gathered via observation and interview(s), (including statement from licensee that she was currently training her new staff has provided evidence to support the allegation regarding supervision.
On 4/27/2021, LPA's observed staff signatures on sign in and out sheets during drop off at the facility and pick up from the facility. Copies were taken. LPA explained that the regulation indicates that authorized representative must sign the child in or out of the facility and that person who drops off and picks up the child from the facility must sign them in and out. Per licensee, sign in and out procedures only changed due to Covid-19. LPA reviewed waiver that is required to be submitted by licensee in order to have staff sign in and out for Covid-19 related purposes and that licensee notifying the parents in writing was not sufficient. LPA encouraged licensee to review the provider information notices (PINS) and participate in Department licensing calls that are offered to get the most up to date information regarding waivers and updates as it relates to Covid-19. The information gathered via record review and interview has provided evidence to support the allegation regarding sign in and out procedures.
This agency has investigated the complaint allegations stating that "lack of supervision resulting in day care child hitting another child" and "child(ren) are signed in and out by unauthorized representative". The Department has found that the complaint was SUBSTANTIATED, meaning the preponderance of evidence standard has been met.
Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, the following deficiencies were cited today (see 9099-D).An exit interview was conducted with licensee Carrie Risk and a copy of Appeal Rights were provided.
A copy of LIC 9224 (Acknowledgement of Receipt of Licensing Reports) was provided to licensee and instructions on how to complete this form was reviewed. A copy of this report must be made available to all parents of currently enrolled children and to the parents of any newly enrolled children for the next 12 months. LIC 9224 must be in each child's file.
