25 | On 07/11/2023, Licensing Program Analysts (LPAs) Candis Rodriguez and Aurelio Mendoza conducted an unannounced Case Management inspection at facility. LPAs met with Owner Laurie Raths, explained purpose of inspection, and took a census.
On 07/03/2023, facility reported to Community Care Licensing (CCL) that Teacher #1 slapped Child #1 on the face. Facility conducted an investigation and reported that Child #2, Child #3, and Child #4 witnessed Teacher #1 slap Child #1. Facility reported that Teacher #1 was terminated on the day of the incident.
Child #2 and Child #3 are not present at the facility today to be interviewed. LPAs interviewed Child #4. Child #4 stated he witnessed Teacher #1 slap Child #1 on the face, with her left hand in an open position.
Director stated parents of Child #1 were notified of the incident. Child #1 is present today, but due to being non-verbal was not interviewed by LPAs.
LPA obtained copies of statements gathered by facility during investigation. Due to multiple children witnessing Teacher #1 slap Child #1, facility will be cited for violating Child #1's personal rights.
Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, LIC 809-D). Owner was provided a copy of their appeal rights.
This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
Exit interview conducted and report was reviewed with Owner.
